Our Commitment to Privacy

This privacy statement (“Privacy Statement”) describes the Sunflower Wellness (“Sunflower Wellness, “we” or “us”) commitment to maintaining the confidentiality of the information that we collect, use, maintain, and disclose. This privacy statement governs our use of information disclosed to Sunflower Wellness regarding the undersigned client (“Client” or “you”).

Sunflower Wellness only uses and discloses your information for mission-related activities and operations in connection with providing you with exercise consulting sessions, personal training sessions, exercise classes and other related services (collectively, the “Services”), and in other limited circumstances such as when required for law enforcement or for public health activities. In addition, use and disclosure of your information is limited to a “minimum necessary” standard, except in certain situations specified by law. Other uses and disclosures of your information, including disclosures to third parties, shall not generally occur unless you authorize such disclosure.

How Does Sunflower Wellness Collect and Use Information?

Sunflower Wellness collects personal information whenever you fill out an intake form, participate in an intake meeting with a Sunflower Wellness representative, participate in the Services or attend other Sunflower Wellness events, when you visit the Sunflower Wellness website, and when you otherwise voluntarily provide Sunflower Wellness with such information. We also collect personal information when you are referred to us by your health provider or caregiver or by a health club or other fitness facility that is owned and operated by a third-party (such facility, a “Club”).

Below are general categories of information that we collect. All information that you provide to Sunflower Wellness is voluntary, but certain information is required to use the Services.

Contact information. We may ask for contact information such as your name, address, telephone number, e-mail address, and contact preferences. We collect this information so that we may keep you informed about Sunflower Wellness, invite you to upcoming Sunflower Wellness classes and events in your area, inform you of volunteer or other opportunities to support Sunflower Wellness’ mission, to provide you with cancer and exercise information, or to follow-up on a request for Services. We consider this information private and limit how it is used and disclosed.

Health information provided by you. If you contact Sunflower Wellness seeking information regarding the Services or wishing to participate in the Services, then we may ask for certain health information such as your type of cancer, date of diagnosis, stage of cancer, symptoms, current treatments and medications, date of any treatments, exercise limitations and other relevant health information. We use this information to help us better serve you by providing personalized and tailored Services in light of your particular cancer diagnosis and experience. Further, we rely on this information to ensure that the Services we provide are appropriate in light of any exercise restrictions and your current medical condition. Health information may be shared for the purpose of evaluating your eligibility for the Sunflower Wellness services, including with Sunflower Wellness employees and volunteers, exercise consultants and class instructors. We treat this health information as confidential and will not disclose such information to third-parties not described hereunder without your consent.

Information collected in the course of the Services: We will maintain certain contact information and health information (as provided to us by you, your physician or Clubs) in connection with your participation in the Services. We may share this information within Sunflower Wellness, and with our affiliates and other third-parties who will use your information in the course of providing the Services, including but not limited to: (a) trainers and instructors who work with Sunflower Wellness; (b) our affiliated Clubs; and (c) exercise class providers and personal trainers, whether provided by Sunflower Wellness or by a Club. Further, any information you share with a Club may be provided to us in connection with your participation in the Services. We use this information to help provide you with information about the Services and to stay informed about our Clients’ participation in the Services (for example, tracking participation in exercise classes, Client feedback and concerns, suggestions for new exercise programs, and so forth).

Research information. Sunflower Wellness may collect and use certain information to support research studies related to the Sunflower Wellness mission (for example, studies on the impact of exercise on cancer treatment and recovery). We may share information you provide with academic research investigators for the purpose of facilitating such research studies. In the event that we share your information with a third-party researcher outside of Sunflower Wellness, your information is shared in a confidential manner that does not identify you individually (i.e., we may provide information on your cancer type, exercise program and results, but won’t identify you) unless you consent to being identified.

Financial information. If you pay for any Services or make a donation to Sunflower Wellness, we may ask for financial information such as a credit card number, billing address and related financial information. From time to time, we may use a third-party payment processor to facilitate such transactions. This information allows us to process your payment or donation. We consider this information confidential.

How Does Sunflower Wellness Protect Your Information?

Sunflower Wellness has adopted a number of recognized standards to protect the privacy of your information, and we have provided a description and an example of these standards below. However, not every particular use or disclosure in every category will be listed.

We restrict and protect how your information is used. We have guidelines which limit access only to those who have a reasonable need to use your information. In addition, we limit how your information is used to only those purposes related to your original inquiry or request. For example, if you come to Sunflower Wellness seeking to participate in the Services, we will use your information to provide exercise consulting and to otherwise tailor the Services to your specific needs. Finally, we may use your information for mission-related activities, management and administration, or to carry out our legal responsibilities. For example, we may use your information to identify a local event that we believe may be of interest to you and invite you to that event. We instruct Sunflower Wellness trainers, staff and volunteers on the importance of our clients’ privacy and on the importance of maintaining the confidentiality of your information.

We restrict and protect how your information is disclosed. On occasion, we may have a need to disclose your information to third parties. We take reasonable efforts to protect these disclosures. For example, we may hire other companies to provide limited services on our behalf, such as creating e-mail campaigns or processing payments or donations. If we use third-parties in this manner, then we provide those companies only the information that they need to deliver the service.

In the event we undergo a business transaction such as a merger or combination with another organization, your information may be among the assets transferred or shared. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Statement, and that any acquirer of our assets may continue to maintain your information as set forth in this Privacy Statement.

We have strong computer security protections. For our electronic data, we have physical, technical, and procedural safeguards to protect your information in a secure database. These standards meet our legal or contractual requirements and ensure your electronic data is as secure as practical.

What Are Your Rights?

Right to access your information. You have the right to (upon request) see the information that we maintain about you. Further, you have the right to request updates or changes to your personal information. Contact us by email or in writing at the address below.

Right to request restrictions. We recognize that you may wish to limit the ways in which we contact you or regarding the internal and external sharing of your contact information. For more information, contact us by email or in writing at the address below.
